Cohabitation agreement (Samboavtal):
In a cohabitation agreement the parties (jointly) agree that the Cohabitees Act (sambolagen) and its rules regarding distribution of property when the cohabitation ends is not applicable. If you would like to regulate different ratios of ownership of a co-operative apartment (bostadsrätt) or other real estate we recommend that you also devise a joint ownership agreement.

Pre-nuptial agreement (Äktenskapsförord):
Make clear what you intend to make private property (enskild egendom) through the agreement. In some cases it is best to make all of the property (acquired before and during the marriage) private. In other cases you might just want to regulate specific items as private. The pre-nuptial agreement has to be registered with the Swedish Tax Agency to be valid.

Begin by ordering an extract from the population register (personbevis) via the Swedish Tax Agency. This needs to be submitted along with the divorce application form. The two documents are sent to the district court (tingsrätten). The application form can be used for both a joint petition for divorce as well as for a separate petition for divorce.

Completion of divorce
If the parties are not in agreement regarding the decision to end the marriage, or if they have a child younger than 16, there is a mandatory 6 month waiting period before the divorce can be finalized. After the 6 months have passed either of the spouses can petition the district court to have the divorce finalized. Keep in mind that if you fail to act within the time set by the court you might have to redo the entire divorce-process up to this point again.

The death of a loved one

Will
A will is a document in which a person regulates the distribution of his or her property in the event of his or her passing. The will is an alternative to the division of estate that is stipulated in law. The will provides means to have the property distributed according to your own whishes should you feel that the law does not offer a satisfying result. For instance you might wish to safeguard the house you share with your cohabiting partner (sambo) or favor someone outside of the family or a special cause. If there is no will the property will go to the heirs in accordance with the Inheritance Code (ärvdabalken). It is important to know that the law requires the will to be certified by two witnesses in order to be valid. If a person benefits from the will he or she is invalid as a witness.
A typical situation where a will is called for is if you wish for a person who is not an heir by default according to the Inheritance Code to take part in your estate.

Deed of gift
Clearly state what is gifted including, if any, reservations, provisions or conditions for the gift. For instance gifts can be given on the condition that the gift is to be considered as private property in a divorce, an advance payment of the inheritance (to be adjusted for in the division of estate), or with rights of use. In order for gifts between spouses to be valid the deed of gift need to be registered with the Swedish Tax Agency, in the registry of marriage. (äktenskapsregistret)

Debentures
A debenture needs to clearly state the amount, how payment is to be made, and what happens if payments are not made. It is only the debtor, the person owing money, who has to sign the debenture.
