Prenuptial agreement

The spouses may in a contract between them, called a prenuptial agreement, agree that certain property shall be separate property. This property is not included in the division of property in case of a divorce. Any property that is not seperate property is so-called marital property and must be included in the division of property after a divorce.

A prenuptial agreement can be written both before and after the marriage has been concluded. The agreement can be designed almost any way you want. There are no formal requirements except that it must be in writing and signed by both spouses. The prenuptial agreement must be registered with the tax authorities to be valid.
